Terms of Service Agreement

1. Acceptance of Terms
By accessing or using the services provided by Johnny Saldana Photography, you agree to comply with and be bound by the terms and conditions outlined in this Terms of Service Agreement ("Agreement"). If you do not agree to these terms, please refrain from using our services.
2. Services
a. Photography Services: Johnny Saldana Photography offers professional photography services for various occasions, including but not limited to weddings, events, portraits, and commercial projects.
b. Pricing: Our pricing for photography services is outlined in our separate pricing document or contract, which is agreed upon before each project. Any changes to the pricing will be communicated and agreed upon in writing.
3. Booking and Payment
a. Booking: To secure our services, clients are required to sign a booking agreement and make a non-refundable booking fee payment as specified in the booking agreement. The booking fee is deducted from the total cost of services.
b. Payment: Full payment for photography services is due as outlined in the booking agreement. Failure to make timely payments may result in the cancellation of services.
4. Cancellation and Rescheduling
a. Cancellation by Client: In the event of a client's cancellation, the booking fee is non-refundable. Any additional payments made may be refundable, subject to the terms specified in the booking agreement.
b. Rescheduling: Clients may request to reschedule a photography session, subject to availability. Johnny Saldana Photography will make reasonable efforts to accommodate rescheduling requests.
5. Ownership and Usage Rights
a. Copyright: Johnny Saldana Photography retains the copyright to all photographs taken during the project. Clients are granted a personal, non-exclusive license to use the photographs for personal use, such as printing and sharing with family and friends.
b. Commercial Use: Any commercial use of photographs, including but not limited to publication, promotion, or sale, requires the written consent of Johnny Saldana Photography.
c. Johnny Saldana Photography grants clients permission to share and post the photographs on personal social media accounts, provided that a photography credit is clearly referenced to Johnny Saldana Photography. The credit should include our name, "Johnny Saldana Photography," and may also include our social media handles or website, where applicable. This credit should be prominently displayed in the post or caption associated with the shared photograph.
For example, a suitable credit format might be: "Photo by Johnny Saldana Photography (@JohnnySaldanaPhoto) - www.johnnysaldanaphoto.com."
This usage is subject to the terms outlined in this Agreement, and clients are not permitted to sell, license, or transfer the photographs to third parties for commercial use without the written consent of Johnny Saldana Photography, as specified in Section 5b.
6. Privacy and Data
a. Privacy: Johnny Saldana Photography respects your privacy. Personal information collected during the course of our services will be used solely for the purpose of providing photography services.
b. Data Security: We take reasonable measures to safeguard your data; however, we cannot guarantee the security of digital files or photographs shared electronically.
7. Liability and Indemnification
Johnny Saldana Photography is not responsible for any loss, damage, or injury incurred during a photography session. Clients agree to indemnify and hold Johnny Saldana Photography harmless from any claims or liabilities arising from the use of photographs.
8. Governing Law and Jurisdiction
This Agreement is governed by the laws of Texas, United States of America, and any disputes will be subject to the exclusive jurisdiction of the courts in your city.
9. Changes to Terms
Johnny Saldana Photography reserves the right to modify these terms at any time. Any changes will be communicated to clients and will apply to future projects.
